Terms of Use

1. Purpose

Photographes.io is an online directory allowing clients to search, compare and contact professional photographers for free, by city, department, region and specialty. Photographers have a public profile showcasing their portfolio, services, location and reviews.

Photographes.io is a technical intermediary. We are not a party to the services, contracts or exchanges concluded between clients and photographers, and we charge no commission on those services.

2. Definitions

• “Platform”: the photographes.io website and its services.
• “User”: any person accessing the Platform.
• “Client”: a User looking for a photographer.
• “Photographer”: a professional with a published profile on the Platform.
• “Content”: any item published on the Platform (profile, portfolio, text, review, message).

3. Acceptance

Using the Platform implies full acceptance of these Terms. If you do not accept them, you must not use the Platform.

When creating an account, the User expressly accepts these Terms and, where applicable, the Terms of Sale for paid services.

4. Access and account

Browsing the Platform is free. Some features (favorites, contact, photographer area) require an account.

The User undertakes to provide accurate, up-to-date information, to keep their credentials confidential and to promptly notify Photographes.io of any unauthorized use of their account.

5. User roles

• The Client can search for photographers, save favorites and send contact requests.
• The Photographer manages their profile, portfolio and services and receives clients' contact requests.
• Each User is solely responsible for the information they publish and the exchanges they initiate.

6. User obligations

Each User undertakes to:

• provide accurate, non-misleading information;
• respect other Users and applicable laws;
• not publish unlawful, defamatory, infringing content or content harming third-party rights;
• use the Platform only for legitimate purposes, without disrupting it or improperly collecting others' data.

7. Published content

The Photographer retains full intellectual property in the content they publish (photographs, texts). They warrant that they hold the necessary rights and that the image rights of depicted individuals are respected.

By publishing content, the Photographer grants Photographes.io a non-exclusive, royalty-free license limited to hosting, displaying and promoting their profile on the Platform and its channels. Photographes.io never uses this content for advertising unrelated to the profile, nor to train artificial intelligence models.

8. Reviews and ratings

Displayed reviews may come from clients or be imported from third-party sources (e.g. Google), with their origin indicated. Reviews are the responsibility of their authors.

Photographes.io reserves the right to moderate or remove any review that is manifestly false, unlawful or contrary to these Terms.

9. Platform intellectual property

The structure, trademarks, databases and elements of the Platform are protected by intellectual property law and remain the property of LUMY.MEDIA. Any unauthorized reproduction or extraction is prohibited.

10. Liability

Photographes.io acts as a technical intermediary. We do not guarantee that any service will be concluded and are not liable for the quality, timing or performance of services provided by photographers.

Photographes.io uses reasonable means to ensure the availability and security of the Platform, without guaranteeing uninterrupted access. We are not liable for content published by Users.

11. Reporting unlawful content

In accordance with French law, any manifestly unlawful content can be reported to [email protected], indicating the notifier's identity, the description and URL of the content and the legal grounds. Manifestly unlawful content is removed as soon as possible.

12. Suspension and termination

The User may delete their account at any time. Photographes.io may suspend or terminate an account in case of breach of these Terms, fraud or unlawful content, without prejudice to any rights acquired under a paid subscription (see Terms of Sale).

13. Personal data

The processing of personal data is described in our Privacy Policy, available at photographes.io/en/confidentialite.

14. Changes to the Terms

Photographes.io may amend these Terms to reflect legal or functional changes. The applicable Terms are those in force when the Platform is used.

15. Governing law and jurisdiction

These Terms are governed by French law. Failing an amicable resolution, the French courts have jurisdiction, under the conditions provided by the French Consumer Code for consumers.
