Terms of Sale

1. Purpose and scope

These Sale Terms apply to the subscription of paid offers (the “Premium” plan) by a photographer (the “Professional Client”). They complement the Terms of Use.

Matching between clients and photographers remains free and gives rise to no commission.

2. Offers and features

The Premium plan provides additional visibility and profile-management features. The detailed features and current prices are presented on the dedicated page of the site (become a photographer / pricing).

3. Pricing

Prices are shown in euros. Applicable VAT conditions are specified at checkout and on the invoice. Photographes.io may change its prices; new prices apply to subscription periods after they take effect.

4. Subscription

Subscription takes place online from the photographer area. The order is confirmed after acceptance of these Sale Terms and confirmation of payment. A summary and an invoice are made available to the Professional Client.

5. Payment

Payments are processed by our provider Stripe, PCI-DSS certified. Photographes.io stores no banking data (card number, security code). In case of payment failure, access to Premium features may be suspended.

6. Duration and renewal

The subscription is taken out for the duration indicated at checkout (monthly or annual) and may renew automatically, unless terminated as set out below. The Professional Client is informed of renewal dates.

7. Right of withdrawal

For Professional Clients acting for business purposes, the statutory right of withdrawal under the French Consumer Code does not apply, unless otherwise stated.

Where a 14-day right of withdrawal applies, the Client may request immediate performance of the service and acknowledges that this right ends once the service is fully performed, and that an amount proportional to the service already provided may remain due.

8. Termination

The Professional Client may cancel their subscription from their account or by request to [email protected]. Termination takes effect at the end of the current subscription period; Premium features remain accessible until then.

Photographes.io may terminate the subscription in case of serious breach of the Sale Terms or the Terms of Use.

9. Refunds

Except where required by mandatory law or as a goodwill gesture, subscription periods already started are not refunded. Requests can be sent to [email protected].

10. Changes to offers and Sale Terms

Photographes.io may change its offers and these Sale Terms. The Sale Terms applicable to a subscription are those accepted at subscription or renewal.

11. Liability

Photographes.io uses reasonable means to ensure the availability of the service. Its liability is limited, as permitted by law, to direct and foreseeable damages.

12. Personal data

Processing related to billing and subscriptions is described in the Privacy Policy (photographes.io/en/confidentialite).

13. Governing law, mediation and jurisdiction

These Sale Terms are governed by French law. In case of dispute, an amicable solution will be sought first. Failing that, the competent courts are determined under ordinary law; for consumers, the protective provisions of the French Consumer Code apply.
